Getting around Bondi Beach on two wheels, on foot or by bus

Foreshore Road and General Holmes Drive carry container trucks to and from Port Botany, close to homes in Botany and Matraville. If one of those trucks hit you on foot or on a bike, the claim goes to the truck's insurer. Near Bondi Junction station, buses pull in and out, taxis and rideshare cars stop briefly, and people cross between them. Injuries in that mix are often motor accidents, so note the vehicle's registration or route number. On Campbell Parade or a side street, a crash with a motor vehicle is generally a CTP matter. If only the road surface brought you down, a cyclist usually has no CTP claim, though a motorcyclist's own Green Slip may still pay.

Is what happened near Bondi Beach a motor accident?

Most crashes involving a car, truck, bus or motorbike are motor accidents, whoever was hurt. A car that hit you on a scooter still carries a Green Slip, but expect questions about where you were riding and the type of device. Check before accepting a refusal.

E-scooters raise a question of their own. A scooter isn't covered by CTP insurance itself, so if a scooter rider knocked you down on a footpath, a CTP claim is unlikely and another path may apply. If a car hit you while you were on a scooter, a claim against the car's insurer may still be possible. Have the specific facts checked.

Crashes with trucks: what's different

Heavy-vehicle crashes often draw in more people than a car crash: an operator, perhaps a separate trailer owner, a company that loaded the truck, and other drivers. Your injury claim still starts in one place, the CTP insurer of the vehicle at fault. Questions about the other parties can wait, and a lawyer can look at them if a damages claim follows.

If you think a truck's camera, its telematics or the driver's work diary would help show what happened, raise it early. Police may obtain some records during an investigation, and the insurer may request others. A lawyer can formally ask the operator to keep records, which matters because some are overwritten or discarded after a while.

Pedestrians hit by a vehicle

Not every pedestrian injury happens on a street. Shopping centre, station and hospital car parks are open to the public, and a person hit there by a car that is reversing or turning can usually claim. A vehicle rolling down a home driveway can also be a motor accident, sometimes involving a child and a family car. The details matter, so check before assuming you can't claim.

When a driver says you stepped out suddenly, video from a shop, a bus or a council camera may show otherwise. Ask the owner in writing to keep it, giving the date, time and exact spot. Do it quickly, or have someone do it for you while you recover, because many systems record over within days.

Riders: solo crashes, gear and lane position

Missing or inadequate gear can become an argument: the insurer may claim a particular injury would have been less serious with proper protection. Where the evidence backs that up, contributory negligence can reduce the claim by a percentage. If the rider is found more than 61% at fault, the damages claim is lost, and statutory benefits are generally limited to the first 52 weeks. Keep damaged gear unrepaired, and photograph it from every side.

When a pothole, oil or loose gravel is the only reason a rider came down, there is usually no other vehicle's Green Slip to claim against. The rider's own bike insurer may still pay statutory benefits. Any complaint about how a road was maintained sits outside CTP, with its own rules and time limits, so get advice early if that's your situation.

Hurt on a bus, in a taxi or while delivering

A passenger thrown forward when a bus braked hard, or hurt when a taxi was hit side-on, has a motor accident claim in most cases. Write down the route or cab number, the time, and whether you were seated or holding a rail. Screenshot the rideshare trip if there was one. These records show you were on board and help identify the right insurer.

If you were delivering when a vehicle hit you, the order of claims matters. Where you were working as an employee, workers compensation generally comes first and CTP benefits aren't usually paid on top, though a damages claim against the driver's CTP insurer may remain.
