When your case calls for it

An independent CTP lawyer

  • Your claim has been denied, or liability is disputed.
  • Your injury has been called a threshold injury and your doctors disagree.
  • Weekly payments or treatment have been cut off.
  • Fault is disputed, or you've been found mostly at fault.
  • The insurer has made an offer.
  • A damages claim may be open, your injuries are serious, or someone has died.

For treatment and medical evidence

Doctors & allied health

  • You need a Certificate of Fitness for the insurer.
  • You need a diagnosis, a treatment plan or referrals.
  • You need physiotherapy, psychology, exercise physiology or other rehabilitation.
  • Your GP isn't familiar with CTP claims.
  • The insurer is waiting on medical evidence before it decides.
Doctors & allied health

Medical & allied health

Doctors and allied health for your claim

Most CTP claims run on medical evidence: the diagnosis, the Certificate of Fitness, treatment plans and progress notes. If that's what you need, we can point you to doctors experienced with CTP claims and allied health providers.

  • Physiotherapy
  • Psychology and counselling
  • Exercise physiology
  • Other allied health, such as occupational therapy

You choose who you see, and we'll tell you if a provider we refer you to is connected with us. The insurer decides which treatment it pays for, based on what is reasonable and necessary for your accident injuries.

Stage by stage

What an independent CTP lawyer typically does

Not every claim needs a lawyer, and those that do rarely need one at every stage. As a general guide, this is where a specialist motor accident lawyer usually adds value.

  1. Lodging your claim

Right insurer, right form, on time. To get weekly payments back-paid to the day after the accident, the insurer generally needs your claim within 28 days.

  2. Statutory benefits

Weekly payments, and treatment and care. Checking the pre-accident earnings used, the calculations and the treatment approvals.

  3. Internal review

Asking the insurer in writing to reconsider a decision, with evidence that answers its reasons.

  4. PIC disputes

If internal review doesn't fix it, many disputes can go to the Personal Injury Commission, an independent tribunal.

  5. Damages claim

A lump sum claim, possible if another driver was at fault, you weren't mostly at fault, and your injury is more than a threshold injury.

  6. Settlement

Explaining an offer, negotiating with the insurer, and making sure you understand what you're signing.

Costs

What about costs?

Our claim check is free and there's no obligation to go any further.

Many motor accident lawyers offer ‘no win, no fee’ arrangements. Generally, that means you don't pay their professional fees unless the claim succeeds, but terms differ, including how disbursements such as medical reports are handled. Legal costs for some parts of a NSW CTP claim are also regulated. Ask for a written costs disclosure and a plain-English costs agreement before you sign.

Treatment is separate. The CTP insurer pays for treatment and care that is reasonable and necessary for your accident injuries, within the benefit periods that apply to you, so check before you commit to costs.
