1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the website ctplawyer.com.au and any associated services, forms, or communications (together, the "Site"). CTP Lawyer is operated by Work Cover Doctors Australia Pty Ltd ("we", "us", or "our").

By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Disclaimer. If you do not agree, you must not use the Site.

2. Nature of Services

CTP Lawyer is a free, general-information service for people injured in motor vehicle accidents in New South Wales who are navigating the Compulsory Third Party (CTP) injury scheme. We publish general information about how the NSW CTP scheme generally works, offer a free claim check, and — where you consent — may refer you to independent third-party providers (together, "Providers"), depending on what your claim needs:

• independent, specialist motor accident (CTP) lawyers ("Lawyer" or "Lawyers"); and
• doctors and allied health providers, such as physiotherapists, psychologists and exercise physiologists ("Healthcare Providers").

CTP Lawyer is not a law firm or a healthcare provider. We do not employ solicitors, we do not provide legal advice, medical advice or treatment, and we do not act for you in any claim or dispute. Any legal advice or representation is provided solely by the Lawyer you choose to engage, and any medical assessment, advice or treatment is provided solely by the Healthcare Provider you choose to see. Providers are independent and exercise their own professional judgement, and they are responsible for their own advice, treatment, actions, and omissions.

3. Eligibility for Use

By using the Site, you represent and warrant that:

• You are at least 18 years of age, or are using the Site under the supervision of a parent or guardian;
• You are legally capable of entering into binding agreements; and
• All information you provide is accurate, complete, and not misleading.

We may suspend or terminate access if we reasonably believe these conditions are not met.

4. User Obligations

You agree to:

• Provide accurate and complete information when submitting any form or enquiry;
• Use the Site only for lawful purposes and in line with these Terms;
• Not impersonate another person or misrepresent your identity;
• Not interfere with the operation or security of the Site; and
• Not use the Site to transmit viruses, malware, or other harmful material.

5. No Solicitor-Client or Doctor-Patient Relationship

Submitting a claim check, enquiry, or any other communication through the Site does not create a solicitor-client relationship, a doctor-patient or other treating relationship, or any other professional relationship, between you and CTP Lawyer. Nothing on the Site is legal or medical advice. A solicitor-client relationship arises only if you separately engage a Lawyer directly, on terms you agree with that Lawyer, and a treating relationship arises only between you and a Healthcare Provider you choose to see.

6. Referrals to Independent Providers

Where you consent, we may share your information with Providers to facilitate a referral. You choose whether to proceed with any Provider we refer you to, and you are never obliged to use one. We'll tell you if a Provider we refer you to is connected with us.

We do not guarantee that a Lawyer will accept your matter, that any particular outcome will result, or that a Lawyer will act on a "no win, no fee" basis. We do not guarantee that a Healthcare Provider will be available to see you, that any treatment will be approved or funded by a CTP insurer, or any particular health or recovery outcome.

Providers are responsible for their own conduct, advice, treatment, licensing or registration, professional indemnity insurance, and compliance with the professional and regulatory requirements that apply to them (including, for Lawyers, the legal profession regulatory regime in NSW).

To the extent permitted by law, CTP Lawyer is not liable for the quality, timing, accuracy, or outcome of any advice, treatment or service provided by a Provider.

7. No Legal or Medical Advice; No Guaranteed Outcome

Content on the Site — including articles, guides, FAQs, and the results of our free claim check — is general information about the NSW CTP scheme only. It is not personal legal or medical advice, does not take your individual circumstances into account, and must not be relied on as a substitute for advice from a qualified, independent lawyer or from your own doctor or treating practitioner.

We do not promise or guarantee any outcome for your claim, any dollar figure, any treatment approval, or any particular result from using the Site or any Provider we refer you to.

8. Fees

Use of the Site, our claim check, and any referral carry no charge to you. Fees for legal services are a matter between you and the Lawyer you engage, set out in that Lawyer's own costs agreement. Fees for treatment are a matter between you and the Healthcare Provider; whether a CTP insurer pays for any treatment is decided by the insurer under the scheme rules.

9. Intellectual Property

Intellectual property in the Site — including design, text, graphics, layout, software, and other content — is owned or licensed by us.

You may access and view the Site for personal, non-commercial use. You must not reproduce, modify, distribute, or exploit Site materials without our prior written consent.

10. Disclaimer and Limitation of Liability

The Site and its content are provided on an "as is" and "as available" basis. Site content is general information only; it is not personal legal or medical advice, and we do not accept responsibility for anyone relying on it in place of advice from a qualified lawyer or health practitioner about their own situation.

To the fullest extent permitted by law:

• We make no representations or warranties as to the accuracy, reliability, completeness, or suitability of information on the Site;
• We do not warrant that the Site will be error-free, secure, or uninterrupted; and
• We exclude liability for loss, injury, damage, or expense arising from your use of the Site or reliance on its content, except where liability cannot be excluded under the Australian Consumer Law (ACL) or other applicable law.

11. Indemnity

You agree to indemnify and hold harmless CTP Lawyer and its operators, directors, employees, and contractors against claims, losses, damages, liabilities, costs, or expenses (including reasonable legal costs) arising from your use of the Site, your breach of these Terms, or your violation of law or third-party rights.

12. Privacy

Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and disclose personal information under the Privacy Act 1988 (Cth).

13. Availability and Maintenance

We may modify, suspend, or discontinue the Site or any part of it at any time. We are not liable if the Site is unavailable, including for maintenance or technical failure.

14. Termination

We may suspend or terminate your access to the Site without notice if we reasonably believe you have breached these Terms or engaged in conduct detrimental to our operations or reputation.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.

16. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force and effect.

17. Amendments

We may amend these Terms by publishing an updated version on the Site. The updated Terms take effect when published. Continued use after publication constitutes acceptance of the changes.
