If you were hurt riding a motorcycle or scooter in a crash involving another vehicle, you can generally claim through the CTP insurer of the vehicle at fault. If no one else was at fault, you may still be able to claim statutory benefits, usually through your own bike's CTP insurer. It's the same scheme as for drivers, but motorcycle claims often play out differently.

Why fault is often disputed in motorcycle claims

Insurers look closely at a rider's speed, lane position, visibility and manoeuvres. Lane filtering is legal in NSW in some circumstances, but whether it was done lawfully at the moment of a crash is often argued. Drivers frequently say they didn't see the bike, which doesn't settle fault on its own.

Fault matters a great deal. If you're found mostly at fault, meaning contributory negligence greater than 61%, weekly payments and treatment and care are generally limited to the first 52 weeks and you can't claim common law damages. A smaller share of fault can still reduce damages. That's why evidence gathered early is so valuable:

  • Helmet camera or dashcam footage, saved in its original form.
  • Photos of the scene, the road surface, skid marks, sightlines and where the vehicles ended up.
  • Witness names and numbers, and the police event number.
  • Your damaged helmet and protective gear, kept rather than thrown away.
  • Your licence details and the bike's registration, in case they're raised.

Injuries and the threshold question

Motorcycle crashes more often cause fractures, nerve injuries, ligament tears and head injuries. A threshold injury is generally a soft tissue injury, and it doesn't include nerve damage or a full or partial tear of a tendon, ligament, meniscus or cartilage. Many riders' injuries fall outside it. If you weren't wholly or mostly at fault, that generally means benefits can continue past 52 weeks, and a damages claim may be open.

Serious injuries also bring whole person impairment into play. Damages for pain and suffering (non-economic loss) are only available if your whole person impairment is more than 10%. Impairment assessments are technical, and a lawyer usually coordinates the medical evidence for them.
