1. Purpose

CTP Lawyer is operated by Work Cover Doctors Australia Pty Ltd ("we", "us", "our"). This Privacy Policy explains how we manage personal information, including health information, in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

CTP Lawyer is a free NSW service for people injured in a motor vehicle accident. We look at where your CTP claim is up to and, with your consent, refer you to the help it needs: an independent CTP lawyer when your case calls for one, and doctors and allied health providers for treatment. This Policy describes how we collect, use, disclose, and protect personal information obtained through CTP Lawyer.

2. Scope

This Policy applies to personal information collected through our website at ctplawyer.com.au, our online free claim check and enquiry forms, the contact form, electronic communications, phone enquiries, and related business activities.

It also applies to employees, contractors, and third parties who handle personal information on our behalf.

3. Definitions

Personal information means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether true or not and whether recorded in a material form or not.

Health information includes information or an opinion about your health, injuries or disability, and about health services provided or to be provided to you. Details about your injuries, symptoms, treatment and treating practitioners that you choose to share with us (for example in a claim check, a call or a contact form) are health information.

Sensitive information includes health information and other sensitive categories defined in the Privacy Act 1988 (Cth). Sensitive information has extra protection under the APPs, and we treat all health information you give us as sensitive information under this Policy.

Provider means an independent lawyer, or a healthcare provider (a doctor or an allied health provider such as a physiotherapist, psychologist or exercise physiologist), that we may refer you to with your consent.

4. Collection of Personal Information

We collect personal information that is reasonably necessary for, or directly related to, our functions and activities — giving you a free claim check, answering your questions about the NSW CTP scheme, and, where you consent, referring you to the help your claim needs: an independent CTP lawyer and/or healthcare providers (doctors and allied health providers).

Types of information may include:

• Full name and contact details (email, phone number);
• Information about your accident and injuries, claim status, and insurer, where you choose to provide it;
• Information about your treatment and treating practitioners (for example your GP, physiotherapist or psychologist), where you choose to provide it;
• Communications with our team and content you include in forms, calls, or emails;
• Technical data such as IP address, browser type, and website usage (see Analytics and Cookies below).

You can ask us to call you with just your name and phone number. Our online claim check form also asks about your accident, injuries and claim so the first call is useful — where you'd rather not say, you can choose "Not sure" or simply call us instead. What you share about your accident and injuries is up to you.

Sensitive information. We only collect health information and other sensitive information with your consent and where it is reasonably necessary for our functions, or where otherwise required or authorised by law. You give that consent when you choose to share the information with us (for example in the claim check, on a call or by email). You can tell us at any time not to use it for a referral.

5. Method of Collection

We usually collect personal information:

• Directly from you when you submit our free claim check, contact form, or call or email us;
• When you interact with our website (including cookies and analytics); and
• From third parties only where permitted by law or where you have consented.

6. Purpose of Collection, Use, and Disclosure

We collect, hold, use, and disclose personal information to:

• Respond to enquiries and provide your free CTP claim check;
• With your consent, refer you to an independent, specialist CTP lawyer and/or healthcare providers (doctors and allied health providers) you may choose to use;
• Maintain business records and manage our relationship with you;
• Comply with legislative and regulatory requirements;
• Handle complaints, quality assurance, and internal audits; and
• Improve our services, including analysis that uses de-identified or aggregated data where appropriate.

We use and disclose health information only for the purpose you gave it to us for (or a directly related purpose you would reasonably expect), with your consent, or where otherwise required or authorised by law. We do not disclose your information to any lawyer or healthcare provider unless you consent to that referral, and we only pass on what is relevant to it. We'll tell you if a provider we refer you to is connected with us.

7. Disclosure of Information to Third Parties

We may disclose personal information to:

• Providers — independent CTP lawyers and healthcare providers (doctors and allied health providers) — but only where you have requested or consented to that referral. You always choose whether to go ahead. Once a Provider receives your information, they handle it under their own privacy and professional obligations;
• Service providers who assist us to operate the website and business (for example hosting, form processing, and analytics), under contractual confidentiality and privacy obligations. Our online forms are processed by Web3Forms, a third-party form service that emails your submission (including any health information you include in it) to our inbox — see Web3Forms' own privacy policy for how it handles data in transit. Each submission is also sent securely to our operator's client management system, so our team can follow up your enquiry and keep a record of it;
• Regulators or authorities where required or authorised by law.

We do not sell, rent, or trade your personal information.

8. Cross-Border Disclosure

Some of our service providers (including website hosting, form processing, and analytics platforms) may store or process data in Australia or overseas. Where personal information is sent outside Australia, we take reasonable steps to ensure overseas recipients handle it in line with the APPs, where required by law.

9. Data Security

We implement technical and organisational measures appropriate to the nature of the information we hold, including access controls, secure transmission where available, and confidentiality expectations for staff and contractors. No online system is completely secure; we encourage you to use caution when submitting sensitive information online.

10. Data Retention and Destruction

We retain personal information, including health information, only for as long as needed for the purposes for which it was collected, or as required by law. When no longer required, we take reasonable steps to destroy or de-identify it in line with APP 11. Copies held by a Provider you were referred to are kept under that Provider's own retention obligations.

11. Website Analytics and Cookies

Our website may use cookies and analytics tools to understand traffic and improve the site. These technologies may collect technical and usage data. You can control cookies through your browser settings; disabling cookies may affect some features.

12. Direct Marketing

We may use your contact details to send service-related communications, such as following up on a claim check you started. Where we send promotional communications, we will provide a way to opt out in line with applicable law (including the Spam Act 2003 (Cth) where relevant).

13. Access and Correction

You may request access to, or correction of, personal information (including health information) we hold about you. Requests should be sent to the contact details below. We may need to verify your identity. We will respond within a reasonable time in line with APP 12 and APP 13. You can also withdraw your consent to a referral at any time by contacting us.

14. Complaints

If you believe we have breached the APPs, you may complain in writing using the contact details below. We will investigate and respond. If you are not satisfied, you may contact the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or 1300 363 992.

15. Updates to this Policy

We may update this Policy from time to time. The current version will be published at https://ctplawyer.com.au/privacy-policy. Continued use of the website after updates constitutes acceptance of the amended Policy, to the extent permitted by law.
