Not every personal injury lawyer runs CTP claims regularly, and CTP has its own forms, time limits and tribunal (the Personal Injury Commission) that a generalist solicitor may not deal with day to day. Here's what's worth checking before you commit to one.
Look for genuine CTP and motor accident experience
Ask directly how much of their current caseload is NSW CTP and motor accident claims, rather than personal injury generally. A lawyer who regularly runs statutory benefits disputes, whole person impairment assessments and Personal Injury Commission matters will typically move faster and anticipate issues a generalist might miss.
Ask about their experience with the Personal Injury Commission
If your claim ends up in dispute, it will most likely be the Personal Injury Commission handling it — merit review, medical assessment review, or a damages claims assessment. Ask whether the lawyer has appeared there, and how often.
Get costs in writing before you sign
A specialist lawyer should be able to explain their costs structure clearly and confidently — whether it's no win, no fee, how disbursements are handled, and how the regulated cost caps apply to your matter. - What's your experience with the Personal Injury Commission specifically?
- How do you charge, and can I see that in writing?
- Who will actually be working on my file day to day?
- How will you keep me updated, and how often?
- What's realistic in terms of timeframe for a claim like mine?
Watch for the claims no honest lawyer makes
Be cautious of any firm that guarantees an outcome, quotes a specific settlement figure before assessing your file, or pressures you to sign immediately. Personal injury legal advertising is restricted in NSW for good reason — a lawyer confident in their experience doesn't need to promise numbers to earn your trust.
Local knowledge vs statewide reach
A lawyer doesn't need an office in your suburb to run your claim well — most CTP work happens by phone, email, video call and correspondence with the insurer, not in-person meetings tied to a physical location. What matters more is genuine familiarity with the NSW scheme, the Personal Injury Commission, and how the specific insurer handling your claim tends to operate, none of which depends on geography.

- Pressure to sign a costs agreement on the spot, before you've had time to read it properly.
- Vague or evasive answers when you ask directly how they charge.
- Promises about a specific compensation figure before reviewing your medical evidence.
