Road injuries near Sawtell: where claims start

The Pacific Highway and the Oxley Highway carry long-distance and local traffic through the Mid North Coast. If a crash on either hurt you, the claim generally runs through CTP, however far you are from Sydney. Whether the crash was on Sawtell Road or a quiet local street, what counts is that a vehicle was involved. That generally makes it a CTP claim, which is the kind of claim this site helps with. Where you live in the Coffs Harbour City Council area has no bearing on which lawyer can help. Compensation for a road injury follows statewide rules, so a lawyer's experience with motor accident claims counts for more than their address.

Start with how you were hurt

Before thinking about lawyers, work out which scheme your injury falls under. This site helps with motor accident claims. For other situations, we'll tell you plainly, so you don't lose time in the wrong place.

  • Hurt in a motor accident

A road injury generally runs through CTP

Injuries from a NSW motor accident are generally claimed through the green slip scheme, known as CTP. It covers people, not vehicles. Depending on the facts, it can pay weekly payments, treatment and care, and sometimes a lump sum.

  • Hurt at work

Usually a separate scheme with its own rules

If you were hurt doing your job, rather than in a road crash, that is usually a workers compensation matter. It runs under separate laws from CTP. Let us know what happened, and we'll help you find where to start.

  • Crash while working

Driving for work? Both schemes may be involved

Crashes on the way to or from work depend on the facts: some are workers compensation claims, some are CTP claims and some involve both. If driving was part of your job, workers compensation generally comes first.

Other injuries are usually outside what we help with

Not every injury comes from a vehicle or a job. Public liability claims, TPD claims through superannuation and medical negligence claims are usually outside what we help with, and the claim check will tell you plainly if yours is one.

Do you need a compensation lawyer?

Many motor accident claims run from start to finish without a lawyer. Others turn on a decision, a dispute or a lump sum, and that's where legal help earns its place. These lists are a rough guide; the claim check gives you an answer for your facts.

Often worth talking to a lawyer

  • The injury has cut your income and may keep doing so
  • You've been offered a lump sum and don't know what it covers
  • The crash was some time ago and you're unsure what's still possible
  • Your injury has been called a threshold injury but it's still affecting you

You may not need one

  • The only loss is damage to your car
  • You're comfortable with how the insurer has handled things so far
  • You haven't decided to claim yet and just want the basics

Before you choose any lawyer, work out where your claim is up to: not lodged, benefits being paid, a decision against you, or an offer on the table. The right next step depends on it. How to make a CTP claim

The short version: what you may be able to claim

Compensation after a NSW motor accident generally runs through CTP, the compulsory green slip scheme. It has two parts. Most people can claim statutory benefits, meaning weekly payments and treatment and care, regardless of who was at fault. Some can also claim common law damages, a lump sum, if another driver was at fault, they weren't mostly at fault and the injury is more than a threshold injury.

Your accident date matters more than most people expect. For accidents on or after 1 December 2017, the Motor Accident Injuries Act 2017 sets the rules, and further changes apply to accidents from 1 April 2023. If the crash was before that first date, the older Motor Accidents Compensation Act 1999 applies. That's one reason a general answer only goes so far, and why a claim check starts with the date.

Find your stage, then the right page

A claim rarely needs the same thing twice. Early on, the job is getting the claim in and the evidence started. In the middle, it's keeping benefits on track and your records up to date. At a decision you disagree with, it's the review. Near the end, it may be damages or an offer. Work out which stage you're at, then read the page that deals with that stage.

  • A decision against you: the claim denied page explains internal review and the Personal Injury Commission
  • Thinking about damages: the damages guide below explains what a lump sum can include and when
  • Not sure it's a CTP claim at all: the car accident claim page helps you work that out

Claim words, explained plainly

Much of the confusion in a motor accident claim comes from vocabulary. A single letter can mention statutory benefits, a threshold injury and an internal review, each with a precise meaning. The short definitions below are general and simplified. If a word appears in a decision about your claim, it's worth checking exactly what it means for you.

  • Damages: a lump sum for losses such as past and future earnings, available only in some claims
  • Whole person impairment (WPI): a percentage rating of how much an injury affects you overall, assessed under set guidelines
  • Case manager: the person at the insurer who handles your claim day to day
  • Certificate of Fitness: the claim form that records your injuries and your capacity for work
  • Nominal Defendant: the fund that stands in when the vehicle was unidentified or uninsured

The work behind the title

It helps to think of the role as a set of tasks rather than a title. Explaining entitlements. Collecting evidence. Negotiating with the insurer. Running disputes. Advising on offers. Some claims need all five, some need one or two at a particular moment, and many need none. Knowing which tasks your claim needs makes the question of whether to call a lawyer much simpler.

A lawyer also can't change the scheme's rules. If your injury is a threshold injury, or you were mostly at fault, some forms of compensation may simply not be open to you, and an honest lawyer will say so. That's useful in itself. Knowing early what isn't available saves time and lets you put your energy into the parts of the claim that are.

  • Checking insurer decisions against the rules for your accident date
  • Preparing a review or dispute when a decision looks wrong
  • Arranging expert reports when the claim needs them

Compensation, personal injury, CTP: what's the difference?

Lawyers choose titles partly to match what people type into a search box, so one practice might call itself compensation lawyers on one page and CTP lawyers on another. For you, the difference is small. What you want to know is whether the person you speak with works on NSW motor accident claims regularly, and whether your claim needs them yet.

Who we are

We're a free triage and referral service, not a law firm. If your claim needs legal help, we'll connect you with an independent lawyer experienced in NSW motor accident claims. If it doesn't, we'll say so.

Injuries that aren't motor accident claims

Public liability and TPD claims come up often when people search for a compensation lawyer. Public liability usually covers injuries in a public place or on someone else's property, while TPD usually relates to insurance held through superannuation. Medical negligence claims are separate again. None of them is usually something we help with. And if the only loss is to your car, CTP doesn't pay for it at all. For anything that began with a vehicle, start with the claim check.
