Liverpool & Fairfield · Compensation lawyer help

Looking for a compensation lawyer near Lansvale?

Start with which claim you have. Many motor accident claims run without a lawyer; some clearly need one.

Searching for a compensation lawyer from Lansvale usually starts with a simpler question: can I claim anything at all? If you were hurt in a motor accident in NSW, the answer usually runs through CTP, the green slip scheme. Many people can get weekly payments and treatment costs whoever caused the crash, and some can also claim a lump sum. Our free claim check works out which applies to you, and whether a lawyer would genuinely help.

Lansvale and the kind of claim you have

The Hume Highway, the M5 and the Cumberland Highway carry heavy trucks as well as local traffic. Hurt in a crash with a heavy vehicle? It is still generally a CTP claim, just like a crash with a car. Lansvale is in the Fairfield City Council area, but council boundaries don't change your options. Across NSW, people hurt on the road can use CTP Assist, our free claim check, and an independent lawyer when the claim calls for one. With Vietnamese, Arabic and Khmer spoken in many local homes, some people want to discuss compensation in their first language. CTP Assist, on 1300 656 919, can arrange an interpreter for questions about a motor accident claim.

Start with how you were hurt

The right claim, and the right kind of help, start with one question: how did the injury happen? These four situations cover most of what people mean when they search for a compensation lawyer.

  • Hurt in a motor accident

A road injury generally runs through CTP

Injuries from a NSW motor accident are generally claimed through the green slip scheme, known as CTP. It covers people, not vehicles. Depending on the facts, it can pay weekly payments, treatment and care, and sometimes a lump sum.

  • Hurt at work

Usually a separate scheme with its own rules

If you were hurt doing your job, rather than in a road crash, that is usually a workers compensation matter. It runs under separate laws from CTP. Let us know what happened, and we'll help you find where to start.

    Tell us what happened
  • Crash while working

Driving for work? Both schemes may be involved

Crashes on the way to or from work depend on the facts: some are workers compensation claims, some are CTP claims and some involve both. If driving was part of your job, workers compensation generally comes first.

Other injuries are usually outside what we help with

Not every injury comes from a vehicle or a job. Public liability claims, TPD claims through superannuation and medical treatment complaints are usually outside what we help with, and the claim check will tell you plainly if yours is one.

Is legal help the right next step?

Searching for a compensation lawyer doesn't mean you need one today. Here's when talking to one often makes sense, and when you may manage without. If you're somewhere in between, a free claim check can help you decide.

Often worth talking to a lawyer

  • An insurer letter uses terms you don't follow and asks you to decide something
  • You're not sure what kind of claim you have, and time may be running
  • The injury looks serious or permanent
  • You were told you can't claim, but no one has explained why

You may not need one

  • You just want to know which scheme or insurer to contact
  • You're comfortable with how the insurer has handled things so far
  • Weekly payments and treatment are being paid without argument

Sometimes what a claim needs most is better treatment records rather than a lawyer. The Certificate of Fitness and your treating team's notes carry weight, and we can connect you with doctors and allied health who know CTP claims.

Not quite your situation?

  • If you've already decided to engage someone and want to know what happens at the first meeting and after, the compensation solicitor page walks through it. Compensation solicitor in Lansvale
  • If your injury is serious or likely to be permanent, the injury compensation page explains what that means for a claim, including how impairment is assessed. Injury compensation lawyer in Lansvale
  • If you want to know what records to keep while you recover, and how to choose a lawyer when the time comes, the personal injury lawyer page covers both. Personal injury lawyer in Lansvale

What compensation can mean after a crash

In NSW, the answer to 'can I get compensation?' after a road injury is often yes, in some form. Statutory benefits, such as weekly payments and treatment and care, are available to most people regardless of fault. Common law damages are narrower. They need another driver at fault, you not mostly at fault, and an injury that is more than a threshold injury. The claim check tells you which of the two are likely to apply.

Your accident date matters more than most people expect. For accidents on or after 1 December 2017, the Motor Accident Injuries Act 2017 sets the rules, and further changes apply to accidents from 1 April 2023. If the crash was before that first date, the older Motor Accidents Compensation Act 1999 applies. That's one reason a general answer only goes so far, and why a claim check starts with the date.

Find your stage, then the right page

People searching for a compensation lawyer are at very different points. Some were hurt recently and haven't lodged anything. Some have been receiving weekly payments for months. Some have a refusal letter in front of them, and some are weighing an offer. Each of those is a different question with a different answer, so start by placing yourself on the list below.

  • A decision against you: the claim denied page explains internal review and the Personal Injury Commission
  • Thinking about damages: the damages guide below explains what a lump sum can include and when
  • Not sure it's a CTP claim at all: the car accident claim page helps you work that out

The words you'll see in insurer letters

Much of the confusion in a motor accident claim comes from vocabulary. A single letter can mention statutory benefits, a threshold injury and an internal review, each with a precise meaning. The short definitions below are general and simplified. If a word appears in a decision about your claim, it's worth checking exactly what it means for you.

  • Statutory benefits: weekly payments and treatment and care that most injured people can claim regardless of fault
  • Damages: a lump sum for losses such as past and future earnings, available only in some claims
  • Whole person impairment (WPI): a percentage rating of how much an injury affects you overall, assessed under set guidelines
  • Case manager: the person at the insurer who handles your claim day to day
  • Nominal Defendant: the fund that stands in when the vehicle was unidentified or uninsured

The work behind the title

A compensation lawyer's job is to turn what happened to you into a claim the scheme can pay. In a motor accident claim, that usually means explaining what you're entitled to, gathering the medical and financial evidence, dealing with the insurer, challenging decisions that look wrong and advising you on any offer. Knowing that list helps you judge whether your claim needs any of it right now.

What a lawyer can't do is create evidence that doesn't exist. Your treating doctor's notes, the Certificate of Fitness and records of what the injury stops you doing carry most of the weight. A lawyer's value lies in knowing which of those the insurer will look at, which are missing, and how the rules for your accident date treat them.

  • Checking insurer decisions against the rules for your accident date
  • Negotiating with the insurer over a damages claim
  • Keeping track of the deadlines that apply to you

Compensation, personal injury, CTP: what's the difference?

You'll see the same kind of lawyer described as a compensation lawyer, a personal injury lawyer, a CTP lawyer or a motor accident lawyer. These are mostly descriptions of the work, not separate professions, and many lawyers who handle NSW motor accident claims use several at once. What matters more is experience with the scheme your claim falls under, so ask about that directly.

Who we are

We're a free triage and referral service, not a law firm. If your claim needs legal help, we'll connect you with an independent lawyer experienced in NSW motor accident claims. If it doesn't, we'll say so.

Injuries that aren't motor accident claims

Some injuries lead to claims outside the motor accident scheme. A fall in a shopping centre or on a public footpath is usually a public liability claim. A total and permanent disability (TPD) claim is usually made through the insurance attached to your super. Complaints about medical treatment follow their own path. All three are usually outside what we help with. Damage to your car is different again: CTP pays for injuries, not vehicles, as the car accident claim page explains.
