The short version: what you may be able to claim
Think of it as two layers. The first, statutory benefits, is open to most injured people whoever caused the crash, and covers things like weekly payments while you can't work and treatment that is reasonable and necessary. The second, common law damages, is a lump sum only some people can claim: another driver must have been at fault, you must not have been mostly at fault, and your injury must be more than a threshold injury.

The work behind the title
Most of a compensation lawyer's work is unglamorous. Much of the confusion in a motor accident claim comes from vocabulary. A single letter can mention statutory benefits, a threshold injury and an internal review, each with a precise meaning. The short definitions below are general and simplified. If a word appears in a decision about your claim, it's worth checking exactly what it means for you.
- Threshold injury: the term that replaced 'minor injury' in 2023, generally covering soft tissue and some psychological injuries
- Internal review: asking the insurer to look again at a decision you disagree with
- Certificate of Fitness: the form your doctor completes to record your injuries and your capacity for work
- Nominal Defendant: the fund that stands in when the vehicle was unidentified or uninsured
- Personal Injury Commission: the independent tribunal that decides many disputes in the scheme
Lawyers go by different names
You'll see the same kind of lawyer described as a compensation lawyer, a personal injury lawyer, a CTP lawyer or a motor accident lawyer. Not usually. Most motor accident claims in NSW are made to a CTP insurer, not through a court case against the other driver. Statutory benefits are claimed from the insurer directly, and even a damages claim generally starts as a claim to the insurer and is often resolved without going to court. Some claims do end up in formal proceedings, but that is generally the exception rather than the starting point.
It can be both. After a NSW motor accident, statutory benefits are generally paid as you go: weekly payments if you can't work, and treatment and care costs as they arise. A lump sum only comes from a common law damages claim, which is available in some cases but not all. Plenty of claims involve statutory benefits only. Yes. Receiving weekly payments or treatment approvals doesn't stop you seeking advice, and it doesn't mean your claim is finished.
