Can you claim? Compensation lawyer answers for Bondi

Start with which claim you have. Many motor accident claims run without a lawyer; some clearly need one.

Compensation after a road injury in NSW isn't one payment. It can include weekly payments while you can't work, treatment and care, and for some people a lump sum for lost earnings. Which of those you can get depends on fault, how serious the injury is and when the accident happened. If you were hurt in a crash and live in or near Bondi, a free claim check can tell you where you stand before you speak to anyone.

Where does your claim belong?

The right claim, and the right kind of help, start with one question: how did the injury happen? These four situations cover most of what people mean when they search for a compensation lawyer.

  • Hurt in a motor accident

A road injury generally runs through CTP

If you were hurt as a driver, passenger, rider, cyclist or pedestrian in a NSW crash, your claim generally goes through CTP. That's the scheme this site helps with. Most people can claim statutory benefits whoever was at fault.

  • Hurt at work

Usually a separate scheme with its own rules

An injury at work is usually a workers compensation claim, which is a different scheme from CTP, with its own insurers and rules. Tell us what happened and we can point you to the right help.

  • Crash while working

Driving for work? Both schemes may be involved

If you were driving or riding for work when the crash happened, workers compensation is generally claimed first, through your employer's insurer. A CTP damages claim against the at-fault driver's insurer may still be possible, so get advice before settling anything.

Other injuries are usually outside what we help with

Not every injury comes from a vehicle or a job. Public liability claims, TPD claims through superannuation and medical treatment complaints are usually outside what we help with, and the claim check will tell you plainly if yours is one.

General information, not legal advice. Which scheme applies depends on your facts, and time limits apply.

Compensation claims from Bondi: the local picture

Anzac Parade, Southern Cross Drive and New South Head Road carry heavy traffic through the Eastern Suburbs. A crash on any of them is generally a CTP claim, and the claim check can confirm what else applies. Crashes on the main roads and back streets around Bondi lead to the same kind of claim. What differs from one crash to the next is who was at fault and how badly people were hurt, and those two facts shape any compensation. People in the Waverley Council area deal with the same NSW compensation rules as everyone else. What shapes your claim is how you were hurt, who was at fault and how serious the injury is, not the postcode.

Compensation after a motor accident, in brief

In NSW, the answer to 'can I get compensation?' after a road injury is often yes, in some form. Statutory benefits, such as weekly payments and treatment and care, are available to most people regardless of fault. Common law damages are narrower. They need another driver at fault, you not mostly at fault, and an injury that is more than a threshold injury. The claim check tells you which of the two are likely to apply.

Compensation is not a single cheque. What's available to you depends on the facts: whether someone else caused the crash, whether the insurer accepts that your injury goes beyond the threshold, and how your recovery tracks over time. Those facts can change as the claim goes on, which is why an early answer is a starting point rather than a final word.

Different stages, different questions

A claim rarely needs the same thing twice. Early on, the job is getting the claim in and the evidence started. In the middle, it's keeping benefits and treatment on track. At a decision you disagree with, it's the review. Near the end, it may be damages or an offer. Work out which stage you're at, then read the page that deals with that stage.

Lawyer now, later or not at all?

Searching for a compensation lawyer doesn't mean you need one today. Here's when talking to one often makes sense, and when you may manage without. If you're somewhere in between, a free claim check can help you decide.

Often worth talking to a lawyer

  • An insurer letter uses terms you don't follow and asks you to decide something
  • You've been offered a lump sum and don't know what it covers
  • Your injury has been called a threshold injury but it's still affecting you
  • The injury looks serious or permanent

You may not need one

  • You haven't decided to claim yet and just want the basics
  • Your questions are general ones that CTP Assist can answer free
  • Weekly payments and treatment are being paid without argument

Sometimes what a claim needs most is better treatment records rather than a lawyer. The Certificate of Fitness and your treating team's notes carry weight, and we can connect you with doctors and allied health who know CTP claims.

Not quite your situation?

  • If you've already decided to engage someone and want to know what happens at the first meeting and after, the compensation solicitor page walks through it. Compensation solicitor in Bondi
  • If your injury is serious or likely to be permanent, the injury compensation page explains what that means for a claim, including how impairment is assessed. Injury compensation lawyer in Bondi
  • If you want to know what records to keep while you recover, and how to choose a lawyer when the time comes, the personal injury lawyer page covers both. Personal injury lawyer in Bondi

The words you'll see in insurer letters

Much of the confusion in a motor accident claim comes from vocabulary. A single letter can mention statutory benefits, a threshold injury and an internal review, each with a precise meaning. The short definitions below are general and simplified. If a word appears in a decision about your claim, it's worth checking exactly what it means for you.

  • Statutory benefits: weekly payments and treatment and care that most injured people can claim regardless of fault
  • Threshold injury: the term that replaced 'minor injury' in 2023, generally covering soft tissue and some psychological injuries
  • Whole person impairment (WPI): a percentage rating of how much an injury affects you overall, assessed under set guidelines
  • Case manager: the person at the insurer who handles your claim day to day
  • Nominal Defendant: the fund that stands in when the vehicle was unidentified or uninsured

Why the same lawyer has several titles

'Compensation lawyer' is the broadest of the labels, and 'personal injury lawyer' is close behind. 'CTP lawyer' and 'motor accident lawyer' narrow the field to road injuries under the green slip scheme. In practice, one lawyer may use all four. The useful question isn't which title they use but how much of their work is NSW motor accident claims, because the scheme has its own forms, steps and deadlines.

Who we are

We don't run claims or act for anyone, and we aren't a law firm. We help you work out what kind of claim you have and what help it needs, then connect you with an independent lawyer when the claim calls for one.

What a compensation lawyer does

It helps to think of the role as a set of tasks rather than a title. Explaining entitlements. Collecting evidence. Negotiating with the insurer. Running disputes. Advising on offers. Some claims need all five, some need one or two at a particular moment, and many need none. Knowing which tasks your claim needs makes the question of whether to call a lawyer much simpler.

What a lawyer can't do is create evidence that doesn't exist. Your treating doctor's notes, the Certificate of Fitness and records of what the injury stops you doing carry most of the weight. A lawyer's value lies in knowing which of those the insurer will look at, which are missing, and how the rules for your accident date treat them.

  • Requesting hospital, GP and treatment records
  • Preparing a review or dispute when a decision looks wrong
  • Keeping track of the deadlines that apply to you

Other kinds of claims

Some injuries lead to claims outside the motor accident scheme. A fall in a shopping centre or on a public footpath is usually a public liability claim. A total and permanent disability (TPD) claim is usually made through the insurance attached to your super. Complaints about medical treatment follow their own path. All three are usually outside what we help with. Damage to your car is different again: CTP pays for injuries, not vehicles, as the car accident claim page explains.
