Your first months: the CTP claim timeline
From the day of the crash to the two-year mark, this is how a typical claim for statutory benefits is timed. Your own claim may differ, especially if the insurer disputes something.

Lodged late, but inside 3 months, for an accident from 1 April 2023? Explain the delay fully. An explanation the insurer hasn't rejected within 14 days is treated as accepted, so back-pay can still apply.

The last point to claim
Claims can still be made up to 3 months after the accident, though weekly payments may then only start from the date of the claim. After 3 months, claims are accepted only in limited circumstances.

Weekly payment rates
For the first 13 weeks, payments are up to 95% of what you earned before the accident. After week 13 the rate becomes up to 80% or 85%; your earning capacity decides which. A legislated maximum applies.

Weekly payments generally end
At the 104-week mark, weekly payments generally end. They can run longer only while a common law damages claim is pending, and how much longer depends on the level of impairment.

Lodging the claim: where and how
Before you lodge, report the accident to police if you haven't already. The claim goes more smoothly with a few things ready: the police event number, the other vehicle's registration, your Certificate of Fitness, payslips or tax records showing what you earned, and your employer's details. If you've paid for treatment or medication, keep the receipts too. Missing something shouldn't stop you lodging on time.

Your doctor's part in the claim
The Certificate of Fitness is where your medical story meets the insurer. It lists your injuries and says what work, if any, you can do. If a certificate misses an injury or overstates your capacity, weekly payments may not reflect your situation, so read each one before it goes to the insurer and raise anything wrong with your doctor.

The 52-week limit isn't only about threshold injuries. For accidents from 1 April 2023, it generally applies too if you were wholly or mostly at fault, whatever your injury. For accidents between 1 December 2017 and 31 March 2023, both limits were 26 weeks instead. Children who were 16 or under at the time of the accident are an exception: they can receive treatment and care for as long as they need it, regardless of fault.

Your doctor does. In NSW CTP claims, the Certificate of Fitness records your injuries and your capacity for work, and the insurer relies on it when deciding weekly payments. The first one usually goes in with your claim, and you'll generally need updated certificates while you recover. Read each one before it's sent, and ask your doctor to correct anything missing, such as an injury that showed up days after the crash.
Only in limited circumstances, usually where there's a full and satisfactory explanation for the delay. The rules are strict and depend on your facts. Speak to a lawyer straight away if you're outside 3 months, and gather anything that shows why you couldn't claim sooner, such as a hospital stay, a period when you couldn't manage your affairs or a symptom that only appeared later.
Generally up to 104 weeks, or 2 years. For a threshold injury, or if you were wholly or mostly at fault, they generally stop at 52 weeks for accidents from 1 April 2023. Beyond 104 weeks, payments continue only in limited cases where a damages claim is still pending, which how compensation works explains. Keep your Certificates of Fitness current throughout, because gaps can interrupt payments.
A case manager is usually your main contact at the insurer. They handle your weekly payments, treatment requests and updated certificates, and they pass on the insurer's decisions. Keep a note of each conversation and ask for important decisions in writing. If you disagree with a decision, you can ask for an internal review, generally within 28 days.
Usually it's the CTP insurer of the vehicle at fault. If another vehicle caused the crash, that's usually its insurer; if you were at fault, it's usually your own vehicle's.
