The first weeks after a crash are busy, and the CTP claim can slip down the list. It shouldn't. People in Annandale face the same deadlines as everyone in NSW: 28 days for back-paid weekly payments and 3 months to claim at all, with only limited exceptions. We can check where your claim is up to for free, and point you to legal or medical help only where it's actually needed.

Starting your claim from Annandale
Hurt on Parramatta Road, Victoria Road or in the WestConnex tunnels? Report it to police and keep the event number. The claim form asks for it, and the insurer will generally want the crash to have been reported. If an ambulance took you to Royal Prince Alfred Hospital, the ambulance record and the emergency notes both describe your injuries on the day of the crash. List both on the claim form, since the insurer may ask for them before it decides. At roughly 4 km from the Sydney CBD, Annandale is no further from the CTP system than anywhere else. The Service NSW claim form is online, insurers work by phone and email, and our claim check is by phone and online.

How a CTP claim unfolds over time
From the day of the crash to the two-year mark, this is how a typical claim for statutory benefits is timed. Your own claim may differ, especially if the insurer disputes something.
Day 0
The accident
Your health comes first, then the paperwork. Report the accident to police, keep the event number, and write down the date, time and place while they're fresh, since the claim form asks for all three.
Within 28 days
Lodge your claim
Lodge your claim for statutory benefits within 28 days of the accident so weekly payments can generally be back-paid to the day after. You can lodge through Service NSW online or with the CTP insurer.
Within 14 days of your explanation
A late claim, explained
Lodged late, but inside 3 months, for an accident from 1 April 2023? Explain the delay fully. An explanation the insurer hasn't rejected within 14 days is treated as accepted, so back-pay can still apply.
Within 3 months
The last point to claim
Claims can still be made up to 3 months after the accident, though weekly payments may then only start from the date of the claim. After 3 months, claims are accepted only in limited circumstances.
Weeks 1–13, then 14+
Weekly payment rates
Weekly payments are up to 95% of your pre-accident earnings for the first 13 weeks. From week 14 they're up to 80% or 85%, depending on your earning capacity. An indexed maximum applies.
52 weeks
The threshold and at-fault line
For accidents from 1 April 2023, statutory benefits for a threshold injury, or where you were wholly or mostly at fault, generally end 52 weeks after the accident. Children 16 and under keep treatment and care as long as needed.
104 weeks
Weekly payments generally end
Two years in, weekly payments generally stop unless you've lodged a damages claim that's still pending. To keep them going past 2 years, that damages claim must be lodged within 2 years of the accident.

Getting your claim in
You can lodge a claim for statutory benefits online through Service NSW, or directly with the relevant CTP insurer. If you're not sure which insurer that is, CTP Assist (1300 656 919) can help you identify it. The form asks about the accident, your injuries, your work and the treatment you've had so far, so have those details close by.

The 52-week limit and who it applies to
Plan around the 52-week mark if it applies to you. Keep your Certificates of Fitness current, keep treatment going as your doctor recommends, and ask the insurer in writing what will happen to payments and treatment when the period ends. If you think the threshold decision itself is wrong, you can ask for an internal review, generally within 28 days of receiving it.

Working with the insurer and your case manager
Your case manager will ask for updated Certificates of Fitness, may request medical reports and may arrange an assessment with a doctor the insurer chooses. Attend any assessment you're asked to, and keep your own notes afterwards. If you think a decision is wrong, ask for an internal review rather than letting it sit.
- Keep copies of everything you send
- Reply to requests promptly
- Ask what a request is for if it's unclear
Why the Certificate of Fitness matters
The Certificate of Fitness is where your medical story meets the insurer. It lists your injuries and says what work, if any, you can do. If a certificate misses an injury or overstates your capacity, weekly payments may not reflect your situation, so read each one before it goes to the insurer and raise anything wrong with your doctor.

Do you need a lawyer to make a CTP claim?
Lodging is usually straightforward. What happens afterwards is where some claims need legal help. These lists show common signs either way; the claim check can give you a clearer answer.
Often worth talking to a lawyer
- Weekly payments stopped earlier than you expected
- The insurer says you were mostly at fault
- Your injury has been classed as threshold and your doctor disagrees
- Another driver was at fault and your injury is more than threshold
You may not need one
- You just need to know which insurer to claim against
- Your injury is healing well within the first months
- You need help understanding a question on the form
If your claim is stuck because the paperwork from your treating team is thin, doctors and allied health familiar with CTP claims can help with a clear Certificate of Fitness, records and treatment plans.

What the insurer pays for
If the injury affects your work, weekly payments are generally based on your pre-accident earnings, and the percentage steps down after the first 13 weeks. The insurer relies on your earnings records to set the rate and on your Certificate of Fitness to know what work you can do. There's an indexed maximum, and payments generally stop after 104 weeks.
Treatment and care is the other half of statutory benefits. The insurer generally funds treatment for your injuries, such as GP care, physiotherapy or psychology, where it's reasonable and necessary and within your benefit period. Approval isn't automatic: your practitioner usually requests it, the insurer decides, and you can ask for a review if you disagree.
Rules change
The scheme has changed more than once since 2017. What applies to you depends on your accident date, so check the current rules before relying on any detail.

Documents to gather before you start
You don't need a perfect file to lodge. Start with the basics you have, then add documents as they arrive. Insurers generally ask for more information later, and it's better to lodge within 28 days with a gap in the paperwork than to wait for every page and lose back-pay.
- Date, time and place of the crash
- Hospital discharge summary, if you were admitted
- Recent payslips, tax returns or business records
- Your employer's name and contact details
- Receipts for treatment, medication and travel

Help beyond lodging
If you lodged late, the stakes are higher: claims more than 3 months after the accident are accepted only in limited circumstances. The same goes if you've received a settlement offer or a letter you don't understand. In those situations, an independent lawyer's view is usually worth getting sooner rather than later.

Frequently asked questions
A case manager is usually your main contact at the insurer. They handle your weekly payments, treatment requests and updated certificates, and they pass on the insurer's decisions. Keep a note of each conversation and ask for important decisions in writing. If you disagree with a decision, you can ask for an internal review, generally within 28 days.
Your doctor does. In NSW CTP claims, the Certificate of Fitness records your injuries and your capacity for work, and the insurer relies on it when deciding weekly payments. The first one usually goes in with your claim, and you'll generally need updated certificates while you recover. Read each one before it's sent, and ask your doctor to correct anything missing, such as an injury that showed up days after the crash.
Yes. A claim made within 3 months of the accident is still possible, but weekly payments may then run only from the date you claimed. For accidents from 1 April 2023, if you give a full and satisfactory explanation for the delay, you may still be paid from the day after the accident. An explanation the insurer doesn't reject within 14 days is treated as accepted.
Only in limited circumstances, usually where there's a full and satisfactory explanation for the delay. The rules are strict and depend on your facts. Speak to a lawyer straight away if you're outside 3 months, and gather anything that shows why you couldn't claim sooner, such as a hospital stay, a period when you couldn't manage your affairs or a symptom that only appeared later.
They're a percentage of your pre-accident earnings: up to 95% for the first 13 weeks, then up to 80% or 85% from week 14, depending on your earning capacity. They're subject to a legislated maximum weekly amount that is indexed each year, which is why we don't quote a dollar figure. The insurer works out your rate from your earnings information, so make sure it has the full picture.
Generally up to 104 weeks, or 2 years. For a threshold injury, or if you were wholly or mostly at fault, they generally stop at 52 weeks for accidents from 1 April 2023. Beyond 104 weeks, payments continue only in limited cases where a damages claim is still pending, which how compensation works explains. Keep your Certificates of Fitness current throughout, because gaps can interrupt payments.
