Compensation after a motor accident, in brief
In NSW, the answer to 'can I get compensation?' after a road injury is often yes, in some form. Statutory benefits, such as weekly payments and treatment and care, are available to most people regardless of fault. Common law damages are narrower. They need another driver at fault, you not mostly at fault, and an injury that is more than a threshold injury. The claim check tells you which of the two are likely to apply.
Your accident date matters more than most people expect. For accidents on or after 1 December 2017, the Motor Accident Injuries Act 2017 sets the rules, and further changes apply to accidents from 1 April 2023. If the crash was before that first date, the older Motor Accidents Compensation Act 1999 applies. That's one reason a general answer only goes so far, and why a claim check starts with the date.

When your claim is something else

Not usually. Most motor accident claims in NSW are made to a CTP insurer, not through a court case against the other driver. Statutory benefits are claimed from the insurer directly, and even a damages claim generally starts as a claim to the insurer and is often resolved without going to court. Some claims do end up in formal proceedings, but that is generally the exception rather than the starting point.
Complaints or claims about medical treatment follow their own path and are usually outside what we help with. The same generally goes for injuries that didn't involve a motor vehicle at all, such as a sports injury or a dog bite. It's still worth checking, though. Some injuries that don't sound like road accidents may count as a motor accident in CTP terms, and the claim check can sort that out.

A TPD claim is generally made through the insurance attached to your superannuation, and a public liability claim usually follows an injury in a public place or on someone else's property, such as a fall.
