Hurt on the road? A compensation lawyer guide for Inverell

Plain answers about compensation after a NSW motor accident, and an honest view on whether you need legal help.

Before you choose any lawyer, it helps to know what you'd be choosing them for. A compensation lawyer can explain your entitlements, gather evidence, deal with the insurer and advise on offers, but many motor accident claims never reach that point. If you were injured on the road and live in Inverell, our claim check looks at your situation and tells you plainly whether legal help is worth it now, later or not at all. It's free.

Which kind of claim is this?

The right claim, and the right kind of help, start with one question: how did the injury happen? These four situations cover most of what people mean when they search for a compensation lawyer.

  • Hurt in a motor accident

A road injury generally runs through CTP

If you were hurt as a driver, passenger, rider, cyclist or pedestrian in a NSW crash, your claim generally goes through CTP. That's the scheme this site helps with. Most people can claim statutory benefits whoever was at fault.

  • Hurt at work

Usually a separate scheme with its own rules

An injury at work is usually a workers compensation claim, which is a different scheme from CTP, with its own insurers and rules. Tell us what happened and we can point you to the right help.

  • Crash while working

Driving for work? Both schemes may be involved

If you were driving or riding for work when the crash happened, workers compensation is generally claimed first, through your employer's insurer. A CTP damages claim against the at-fault driver's insurer may still be possible, so get advice before settling anything.

Other injuries are usually outside what we help with

Not every injury comes from a vehicle or a job. Public liability claims, TPD claims through superannuation and medical treatment complaints are usually outside what we help with, and the claim check will tell you plainly if yours is one.

Compensation claims from Inverell: the local picture

If Tamworth Hospital, Armidale Hospital or a hospital in Moree, Inverell, Gunnedah or Narrabri treated you after a crash, those records help show what kind of compensation might apply. A collision on the Gwydir Highway or a nearby street is a motor accident in CTP terms, whoever was driving. From there, fault and how serious your injury is decide which parts of compensation are open to you. People in the Inverell Shire Council area deal with the same NSW compensation rules as everyone else. What shapes your claim is how you were hurt, who was at fault and how serious the injury is, not the postcode.

What compensation can mean after a crash

In NSW, the answer to 'can I get compensation?' after a road injury is often yes, in some form. Statutory benefits, such as weekly payments and treatment and care, are available to most people regardless of fault. Common law damages are narrower. They need another driver at fault, you not mostly at fault, and an injury that is more than a threshold injury. The claim check tells you which of the two are likely to apply.

Three things shape what you can claim: who was at fault, how serious your injury is, and when the accident happened. Fault mostly affects damages and how long some benefits last. Seriousness decides whether your injury is treated as a threshold injury. The date decides which version of the rules applies, because the law changed for accidents from 1 December 2017 and again from 1 April 2023.

The words you'll see in insurer letters

If you're new to claims, the language can feel like a barrier. It needn't be. Most of the key terms describe simple ideas: what the insurer pays, how serious an injury is, and how to challenge a decision. These plain definitions are a starting point, not legal advice, and the rules behind them can change.

  • Statutory benefits: weekly payments and treatment and care that most injured people can claim regardless of fault
  • Damages: a lump sum for losses such as past and future earnings, available only in some claims
  • Threshold injury: the term that replaced 'minor injury' in 2023, generally covering soft tissue and some psychological injuries
  • Internal review: asking the insurer to look again at a decision you disagree with
  • Personal Injury Commission: the independent tribunal that decides many disputes in the scheme

Do you need a compensation lawyer?

Searching for a compensation lawyer doesn't mean you need one today. Here's when talking to one often makes sense, and when you may manage without. If you're somewhere in between, a free claim check can help you decide.

Often worth talking to a lawyer

  • You've been offered a lump sum and don't know what it covers
  • The injury looks serious or permanent
  • Another driver caused the crash and you're still not recovered
  • The crash was some time ago and you're unsure what's still possible

You may not need one

  • Weekly payments and treatment are being paid without argument
  • You're comfortable with how the insurer has handled things so far
  • Your questions are general ones that CTP Assist can answer free

If your recovery has stalled, the next step may be medical rather than legal. We can suggest doctors and allied health who understand CTP claims, the Certificate of Fitness and the reports insurers expect to see.

Not quite your situation?

  • If you've already decided to engage someone and want to know what happens at the first meeting and after, the compensation solicitor page walks through it. Compensation solicitor in Inverell
  • If your injury is serious or likely to be permanent, the injury compensation page explains what that means for a claim, including how impairment is assessed. Injury compensation lawyer in Inverell
  • If you want to know what records to keep while you recover, and how to choose a lawyer when the time comes, the personal injury lawyer page covers both. Personal injury lawyer in Inverell

Where is your claim up to?

People searching for a compensation lawyer are at very different points. Some were hurt recently and haven't lodged anything. Some have been receiving weekly payments for months. Some have a refusal letter in front of them, and some are weighing an offer. Each of those is a different question with a different answer, so start by placing yourself on the list below.

  • Benefits being paid: payment and treatment questions usually go to your case manager first
  • Someone died in the crash: the car accident compensation page covers what dependants may claim
  • Not sure it's a CTP claim at all: the car accident claim page helps you work that out

The work behind the title

A compensation lawyer's job is to turn what happened to you into a claim the scheme can pay. In a motor accident claim, that usually means explaining what you're entitled to, gathering the medical and financial evidence, dealing with the insurer, challenging decisions that look wrong and advising you on any offer. Knowing that list helps you judge whether your claim needs any of it right now.

A lawyer also can't change the scheme's rules. If your injury is a threshold injury, or you were mostly at fault, some forms of compensation may simply not be open to you, and an honest lawyer will say so. That's useful in itself. Knowing early what isn't available saves time and lets you put your energy into the parts of the claim that are.

  • Explaining which benefits and damages your facts may support
  • Requesting hospital, GP and treatment records
  • Negotiating with the insurer over a damages claim

Compensation, personal injury, CTP: what's the difference?

You'll see the same kind of lawyer described as a compensation lawyer, a personal injury lawyer, a CTP lawyer or a motor accident lawyer. These are mostly descriptions of the work, not separate professions, and many lawyers who handle NSW motor accident claims use several at once. What matters more is experience with the scheme your claim falls under, so ask about that directly.

Who we are

We're a free triage and referral service, not a law firm. If your claim needs legal help, we'll connect you with an independent lawyer experienced in NSW motor accident claims. If it doesn't, we'll say so.

Injuries that aren't motor accident claims

Not every compensation search is about a road injury. People also look for help with TPD claims through their super, public liability claims after a fall in a public place, or complaints about medical treatment. Those follow their own rules, and they usually fall outside what we help with. Vehicle damage is never a CTP claim either, because the green slip covers injuries only. If you're not sure which you have, the claim check will say so plainly.
