Your first steps after a crash
- Check on everyone involved, yourself included. If anyone is injured, call 000 straight away and follow the operator's instructions until help arrives.
- Report the crash to police and write down the event number. The insurer will usually ask for it when you lodge a CTP claim.
- See a GP or go to hospital as soon as you can, and say the injuries came from a motor accident so it's written down as the cause.
- Get names and numbers from witnesses before they leave. Photos of the vehicles, number plates and road layout are worth taking if you can do it safely.
- Claim as soon as you can. Within 28 days, weekly payments can be back-paid. You can still claim up to 3 months after the accident, but payments may start later.
- Write down how the injuries affect your days, your sleep and your work. A simple diary, kept from the start, helps if the insurer questions how you're affected.

Claim statutory benefits as early as possible: within 28 days for back-paid weekly payments, and generally within 3 months of the accident. Beyond 3 months, late claims are accepted only in limited circumstances. In many cases, yes. If you're in hospital or finding it hard to manage, a partner, parent or adult child can start the conversation for you. We may need your consent before discussing your details, and the insurer will have its own rules about who it can speak to. For a child's claim, a parent or guardian usually acts for them.
Most insurer decisions can be reviewed. You can generally ask for an internal review within 28 days of receiving the decision, and the insurer usually has 14 days to respond, or longer for some matters. If you still disagree, you can apply to the Personal Injury Commission. A refused claim is one of the situations where an independent CTP lawyer is often worth talking to.
Three main kinds. Doctors experienced with CTP claims, for diagnosis and the Certificate of Fitness. Allied health, such as physiotherapy, psychology and exercise physiology, for treatment and recovery. And an independent lawyer experienced in CTP claims when the case calls for one, for example a refused claim, a threshold dispute or a damages claim. Many people only need the first two.
Usually not. Most injured people can claim statutory benefits whoever was at fault. The main exception is being wholly or mostly at fault, which means contributory negligence above 61%. Then weekly payments and treatment are generally limited to the first 52 weeks, and damages aren't available. Children who were 16 or under at the time can receive treatment and care for as long as they need it, regardless of fault.

Not at first, in most cases. If the crash is also a work injury, you generally need to claim workers compensation through your employer's insurer first. That is a different scheme from CTP, and CTP statutory benefits are generally not payable where workers compensation is available. You may still be able to claim damages from the at-fault driver's CTP insurer, so get advice. Commuting crashes depend on the facts. Tell us about the trip and we can point you to the right help.
Generally, yes. Passengers can usually claim CTP benefits regardless of who was at fault, and the NSW scheme applies to crashes in NSW whether you live in Newcastle, Sydney or overseas. If the crash involved a tour bus or hire car, note the operator and the vehicle registration. Get medical care, keep your records and receipts, and lodge within 28 days if you can.
