After the crash: seven practical steps
- Make the scene safe if you can. Switch on your warning lights, move out of traffic if it's safe to do so, and call 000 if anyone is hurt or trapped.
- Report the crash to police and write down the event number. The insurer will usually ask for it when you lodge a CTP claim.
- Ask your doctor for a Certificate of Fitness. It records your injuries and what work you can manage, and the insurer relies on it.
- Swap details with the other driver: name, phone number, address, licence number and registration. Photograph the vehicles, the scene and any visible injuries.
- Work out which CTP insurer to claim with. It's usually the insurer of the vehicle at fault, and CTP Assist on 1300 656 919 can help you identify it.
- Write down how the injuries affect your days, your sleep and your work. A simple diary, kept from the start, helps if the insurer questions how you're affected.

Key CTP deadlines
Claim statutory benefits as early as possible: within 28 days for back-paid weekly payments, and generally within 3 months of the accident. Beyond 3 months, late claims are accepted only in limited circumstances. A damages claim is generally due within 3 years, and one lodged within 2 years can keep weekly payments going past the 2-year mark while it's pending. Usually not. Most injured people can claim statutory benefits whoever was at fault. The main exception is being wholly or mostly at fault, which means contributory negligence above 61%. Then weekly payments and treatment are generally limited to the first 52 weeks, and damages aren't available. Children who were 16 or under at the time can receive treatment and care for as long as they need it, regardless of fault.

Many motor accident lawyers offer no win, no fee arrangements. Ask for a written costs disclosure before you agree to anything.
Generally, the NSW CTP scheme applies where the crash happened in NSW. If it happened in another state or territory, that place's own scheme usually applies instead, though the details can be complicated, so say where it happened. The date matters too. Accidents from 1 December 2017 fall under the Motor Accident Injuries Act 2017, and earlier ones under the 1999 Act.
The sooner the better. The insurer generally needs your claim within 28 days for weekly payments to be back-paid to the day after the accident. Claims made later, up to 3 months after the accident, are still possible, but payments may then start from the claim date. Common law damages claims generally have to be made within 3 years. Your own dates may differ, so check them early.
We're sorry for your loss. CTP insurance generally covers reasonable funeral expenses regardless of fault, including transporting the person to near their usual home. The deceased person's legal personal representative, usually a close family member, can apply. Dependants may also be able to claim.
