You don't need a lawyer to lodge a CTP claim, and many people never use one. What helps most is having the police event number, a Certificate of Fitness from your doctor, your earnings details and the insurer's name. How a CTP claim unfolds over time
A CTP claim runs to a clock that starts on the day of the accident. Here are the main points on it. Some depend on your accident date, so check which rules apply to you.
Day 0
The accident
Your health comes first, then the paperwork. Report the accident to police, keep the event number, and write down the date, time and place while they're fresh, since the claim form asks for all three.
Within 28 days
Lodge your claim
Lodge your claim for statutory benefits within 28 days of the accident so weekly payments can generally be back-paid to the day after. You can lodge through Service NSW online or with the CTP insurer.
Within 14 days of your explanation
A late claim, explained
Lodged late, but inside 3 months, for an accident from 1 April 2023? Explain the delay fully. An explanation the insurer hasn't rejected within 14 days is treated as accepted, so back-pay can still apply.
Within 3 months
The last point to claim
Three months after the accident is the practical cut-off. Later claims can only be accepted in limited circumstances, usually with a full and satisfactory explanation. If you're past it, speak to a lawyer straight away.
Weeks 1–13, then 14+
Weekly payment rates
Weekly payments are up to 95% of your pre-accident earnings for the first 13 weeks. From week 14 they're up to 80% or 85%, depending on your earning capacity. An indexed maximum applies.
52 weeks
The threshold and at-fault line
At 52 weeks, people with a threshold injury, and people wholly or mostly at fault, generally stop receiving weekly payments and treatment and care. For accidents between 1 December 2017 and 31 March 2023, that limit was 26 weeks.
104 weeks
Weekly payments generally end
Two years in, weekly payments generally stop unless you've lodged a damages claim that's still pending. To keep them going past 2 years, that damages claim must be lodged within 2 years of the accident.
General information, not legal advice. Dates depend on your accident date and circumstances. Rules change, so check the current rules.
Lodging your claim: the practical steps
There are two main ways to lodge: the Service NSW online form, or the CTP insurer itself. Either way, you'll be asked for the accident date and place, the vehicles involved, your injuries, your employer and income, and the doctors treating you. Most people can complete it themselves in one go if they have the details to hand.

What you'll need to lodge
You don't need a perfect file to lodge. Start with the basics you have, then add documents as they arrive. Insurers generally ask for more information later, and it's better to lodge within 28 days with a gap in the paperwork than to wait for every page and lose back-pay.
- Date, time and place of the crash
- Registration numbers of the vehicles involved
- Your Certificate of Fitness
- Receipts for treatment, medication and travel
- Names and numbers of any witnesses

Lodging a claim when you live in Lethbridge Park
After treatment at Blacktown Hospital, Mount Druitt Hospital or Westmead Hospital, the next step is usually a GP visit. That's the time to ask for a Certificate of Fitness, which the insurer needs with your claim. Lodging a claim doesn't mean a trip to Penrith, 9 km away. From Lethbridge Park, the claim form can be completed online, most insurer contact happens by phone and email, and our free claim check works the same way.

Working with the insurer and your case manager
Insurers make decisions under the scheme rules, and your case manager is the person who passes them on. Most contact is routine: updated certificates, treatment approvals, payment questions. Reply promptly, keep copies of what you send, and ask for written reasons for any decision you don't understand. You can challenge decisions if you need to.
- Log every call with the date and the name of the person
- Keep copies of everything you send
- Note the date on any decision letter
The Certificate of Fitness
Ask your GP for a Certificate of Fitness at your first visit after the crash, and keep getting updated ones while you're off work or on reduced hours. Gaps between certificates can cause gaps in payments. If your doctor isn't familiar with CTP forms, a practitioner who knows the scheme can make the process easier.

What statutory benefits cover
Income support is the part of a CTP claim most people ask about first. The insurer can only pay the right amount if it knows what you earned before the accident and what you can earn now, so send your earnings records early and tell it about any return to work. A maximum weekly amount applies and is indexed every year, so check the current figure with the insurer rather than relying on an old one.
Your CTP insurer covers treatment and care for accident injuries where it's reasonable and necessary, within whatever benefit period applies to you. That can include doctor visits, physiotherapy, medication and some travel for treatment. The insurer decides each request, and decisions can be reviewed, so ask before committing to large treatment costs.
Rules change
The scheme has changed more than once since 2017. What applies to you depends on your accident date, so check the current rules before relying on any detail.

When the 52-week limit applies
Some claims are capped at 52 weeks. For accidents on or after 1 April 2023, people whose injury is classed as a threshold injury can receive weekly payments and treatment and care for up to 52 weeks after the accident. The threshold label replaced the older term “minor injury” on that date. Whether an injury is threshold is a medical question in its own right; for running the claim, the point is the time limit it sets.

When to get more help

Is this a claim you can run yourself?
Plenty of claims run from start to finish without legal help. A few need it early. If you recognise your situation below, you'll have a fair idea where you stand.
Often worth talking to a lawyer
- Your injury has been classed as threshold and your doctor disagrees
- Weekly payments stopped earlier than you expected
- The insurer has refused to accept the claim
- Your claim went in more than 3 months after the accident
You may not need one
- Your treatment requests are being approved
- Your weekly payments arrive on time and the amount looks correct
- Your injury is healing well within the first months
A claim runs on medical evidence. If you don't yet have a GP who'll complete a Certificate of Fitness, we can point you to doctors and allied health who know the CTP scheme.

Frequently asked questions
Usually it's the CTP insurer of the vehicle at fault. If another vehicle caused the crash, that's usually its insurer; if you were at fault, it's usually your own vehicle's. If you're unsure, or several vehicles were involved, CTP Assist on 1300 656 919 can help identify the right one. If the vehicle was unidentified or uninsured, the claim goes to the Nominal Defendant, a NSW Government-backed fund that stands in for the missing insurer.
Generally up to 104 weeks, or 2 years. For a threshold injury, or if you were wholly or mostly at fault, they generally stop at 52 weeks for accidents from 1 April 2023. Beyond 104 weeks, payments continue only in limited cases where a damages claim is still pending, which how compensation works explains. Keep your Certificates of Fitness current throughout, because gaps can interrupt payments.
Start with the police event number, the registration of the vehicles involved, your Certificate of Fitness and proof of your earnings, such as payslips or tax returns. Hospital discharge summaries, receipts for treatment and medication, and witness details help too. You don't need everything to lodge. It's better to lodge on time and send extra documents when the insurer asks for them.
A parent or guardian can generally make the claim on the child's behalf, using the same claim form. Aim for the same 28-day mark, and keep the hospital and GP records together. Whoever was at fault, a child who was 16 or under when the accident happened can keep receiving treatment and care for as long as it's needed. If an older child had a job at the time, tell the insurer, because lost earnings may also be part of the claim.
Generally yes, if your doctor says you can. Your Certificate of Fitness records your capacity for work, and weekly payments may be adjusted to take account of what you earn after the accident. Tell the insurer about any work or income straight away. Returning to suitable work, at a pace your doctor supports, is often part of recovery.
They're a percentage of your pre-accident earnings: up to 95% for the first 13 weeks, then up to 80% or 85% from week 14, depending on your earning capacity. They're subject to a legislated maximum weekly amount that is indexed each year, which is why we don't quote a dollar figure. The insurer works out your rate from your earnings information, so make sure it has the full picture.
