Your first months: the CTP claim timeline
From the day of the crash to the two-year mark, this is how a typical claim for statutory benefits is timed. Your own claim may differ, especially if the insurer disputes something.
Day 0
The accident
Make sure everyone is safe first. Then report the crash to police and note the event number, which the claim form asks for. The other vehicle's registration helps identify the right insurer later.
Within 28 days
Lodge your claim
The 28-day mark is the one to aim for: claims received by then generally have weekly payments back-paid to the day after the accident. Lodging sooner also means the evidence is fresh.
Within 14 days of your explanation
A late claim, explained
For accidents from 1 April 2023, a claim made after 28 days but within 3 months may still be back-paid if you give a full and satisfactory explanation. If the insurer doesn't reject it within 14 days, it's treated as accepted.
Within 3 months
The last point to claim
Three months after the accident is the practical cut-off. Later claims can only be accepted in limited circumstances, usually with a full and satisfactory explanation. If you're past it, speak to a lawyer straight away.
Weeks 1–13, then 14+
Weekly payment rates
Weekly payments are up to 95% of your pre-accident earnings for the first 13 weeks. From week 14 they're up to 80% or 85%, depending on your earning capacity. An indexed maximum applies.
52 weeks
The threshold and at-fault line
At 52 weeks, people with a threshold injury, and people wholly or mostly at fault, generally stop receiving weekly payments and treatment and care. For accidents between 1 December 2017 and 31 March 2023, that limit was 26 weeks.
104 weeks
Weekly payments generally end
At the 104-week mark, weekly payments generally end. They can run longer only while a common law damages claim is pending, and how much longer depends on the level of impairment.
General information, not legal advice. Dates depend on your accident date and circumstances. Rules change, so check the current rules.
Getting your claim in
You can lodge a claim for statutory benefits online through Service NSW, or directly with the relevant CTP insurer. If you're not sure which insurer that is, CTP Assist (1300 656 919) can help you identify it. The form asks about the accident, your injuries, your work and your income, so have those details close by.
Not sure which insurer?
If more than one vehicle was involved, or you don't have the other driver's details, CTP Assist on 1300 656 919 can help identify the right insurer.

What statutory benefits cover
Income support is the part of a CTP claim most people ask about first. The insurer can only pay the right amount if it knows what you earned before the accident and what you can earn now, so send your earnings records early and tell it about any return to work. A maximum weekly amount applies and is indexed every year, so check the current figure with the insurer rather than relying on an old one.
Statutory benefits also include treatment and care, but only where it's reasonable and necessary and within your benefit period. For running the claim, the practical points are simple: ask before you commit to a large cost, keep every receipt, and get decisions in writing. A declined request is a decision like any other, and you can generally ask for an internal review within 28 days of receiving it.
Rules change
Benefit rules depend on your accident date and have changed over time. This is general information; check the current rules or ask CTP Assist.

What happens after you lodge
Most of the early weeks after lodging are paperwork. The insurer may ask for tax returns, the other driver's details or a signed authority to collect records, and it will send its decision on liability and weekly payments. Keep every letter in date order. If a promised payment or decision is late, ask your case manager in writing when it's due, and call CTP Assist on 1300 656 919 if you're stuck.

Documents to gather before you start
You don't need a perfect file to lodge. Start with the basics you have, then add documents as they arrive. Insurers generally ask for more information later, and it's better to lodge within 28 days with a gap in the paperwork than to wait for every page and lose back-pay.
- Date, time and place of the crash
- Your Certificate of Fitness
- The other driver's name and contact details
- Receipts for costs you've paid because of the crash
- Names and numbers of any witnesses

Working with the insurer and your case manager
Insurers make decisions under the scheme rules, and your case manager is the person who passes them on. Most contact is routine: updated certificates, benefit decisions, payment questions. Reply promptly, keep copies of what you send, and ask for written reasons for any decision you don't understand. You can challenge decisions if you need to.
- Log every call with the date and the name of the person
- Reply to requests promptly
- Note the date on any decision letter
The 52-week limit and who it applies to
Some claims are capped at 52 weeks. For accidents on or after 1 April 2023, people whose injury is classed as a threshold injury can receive weekly payments and treatment and care for up to 52 weeks after the accident. The threshold label replaced the older term “minor injury” on that date. Whether an injury is threshold is a question in its own right, and it can be disputed; for running the claim, the point is the time limit it sets.

Help beyond lodging
Many people lodge and manage a CTP claim on their own. It's worth getting help when the insurer refuses the claim, classifies your injury as threshold when the evidence points the other way, stops payments, or argues about fault. It's also worth asking a lawyer about damages if your injury is more than threshold and someone else was at fault.

Do you need a lawyer to make a CTP claim?
Lodging a CTP claim is something most people do without any legal help. A few situations change that. Here's a quick guide to which is which.
Often worth talking to a lawyer
- You've been asked to sign a release or settlement
- The insurer says you were mostly at fault
- The insurer's reasons for a decision don't make sense to you
- Weekly payments stopped earlier than you expected
You may not need one
- Your weekly payments arrive on time and the amount looks correct
- You just need to know which insurer to claim against
- The insurer has accepted your claim
A claim runs on paperwork. Keep every letter from the insurer in date order, note the day each decision arrived, and send anything it asks for promptly, keeping a copy for yourself. CTP forms explained

Frequently asked questions
A case manager is usually your main contact at the insurer. They handle your weekly payments, benefit requests and updated certificates, and they pass on the insurer's decisions. Keep a note of each conversation and ask for important decisions in writing. If you disagree with a decision, you can ask for an internal review, generally within 28 days.
No. Most people can lodge a CTP claim themselves, online through Service NSW or with the insurer, and CTP Assist can help with questions for free. A lawyer becomes more useful if the claim is refused, if you're outside the time limits, if the insurer disputes your injury or fault, or if you may have a damages claim. Our free claim check can tell you which applies.
Start with the police event number, the registration of the vehicles involved, your Certificate of Fitness and proof of your earnings, such as payslips or tax returns. Receipts for out-of-pocket costs and witness details help too. You don't need everything to lodge. It's better to lodge on time and send extra documents when the insurer asks for them.
Generally yes, if your Certificate of Fitness says you have some capacity for work. Weekly payments may be adjusted to take account of what you earn after the accident, so tell the insurer about any work or income straight away. Keep your payslips and a note of your hours. If a change in your hours affects your payments, ask the insurer to explain the new amount in writing.
Generally up to 104 weeks, or 2 years. For a threshold injury, or if you were wholly or mostly at fault, they generally stop at 52 weeks for accidents from 1 April 2023. Beyond 104 weeks, payments continue only in limited cases where a damages claim is still pending, which how compensation works explains. Keep your Certificates of Fitness current throughout, because gaps can interrupt payments.
Tell the insurer in writing as soon as you notice, give the correct details and keep a copy. Honest corrections are a normal part of a claim. What causes problems is leaving wrong information on the file, particularly about your earnings or how the crash happened. If the mistake has already affected a decision, ask whether it will be reconsidered, and remember you can generally seek an internal review within 28 days.
