How a CTP claim unfolds over time
From the day of the crash to the two-year mark, this is how a typical claim for statutory benefits is timed. Your own claim may differ, especially if the insurer disputes something.
Day 0
The accident
Make sure everyone is safe first. Then report the crash to police and note the event number, which the claim form asks for. The other vehicle's registration helps identify the right insurer later.
Within 28 days
Lodge your claim
Lodge your claim for statutory benefits within 28 days of the accident so weekly payments can generally be back-paid to the day after. You can lodge through Service NSW online or with the CTP insurer.
Within 14 days of your explanation
A late claim, explained
For accidents from 1 April 2023, a claim made after 28 days but within 3 months may still be back-paid if you give a full and satisfactory explanation. If the insurer doesn't reject it within 14 days, it's treated as accepted.
Within 3 months
The last point to claim
Claims can still be made up to 3 months after the accident, though weekly payments may then only start from the date of the claim. After 3 months, claims are accepted only in limited circumstances.
Weeks 1–13, then 14+
Weekly payment rates
Weekly payments are up to 95% of your pre-accident earnings for the first 13 weeks. From week 14 they're up to 80% or 85%, depending on your earning capacity. An indexed maximum applies.
52 weeks
The threshold and at-fault line
For accidents from 1 April 2023, statutory benefits for a threshold injury, or where you were wholly or mostly at fault, generally end 52 weeks after the accident. Children 16 and under keep treatment and care as long as needed.
104 weeks
Weekly payments generally end
At the 104-week mark, weekly payments generally end. They can run longer only while a common law damages claim is pending, and how much longer depends on the level of impairment.
General information, not legal advice. Dates depend on your accident date and circumstances. Rules change, so check the current rules.
Lodging your claim: the practical steps
There are two main ways to lodge: the Service NSW online form, or the CTP insurer itself. Either way, you'll be asked for the accident date and place, the vehicles involved, your injuries, your employer and income, and any witnesses. Most people can complete it themselves in one go if they have the details to hand.

Your claim paperwork checklist
You don't need a perfect file to lodge. Start with the basics you have, then add documents as they arrive. Insurers generally ask for more information later, and it's better to lodge within 28 days with a gap in the paperwork than to wait for every page and lose back-pay.
- Police event number
- Registration numbers of the vehicles involved
- The other driver's name and contact details
- Recent payslips, tax returns or business records
- Receipts for costs you've paid because of the crash

What statutory benefits cover
If the injury affects your work, weekly payments are generally based on your pre-accident earnings, and the percentage steps down after the first 13 weeks. The insurer relies on your earnings records to set the rate and on your Certificate of Fitness to know what work you can do. There's an indexed maximum, and payments generally stop after 104 weeks.
Think of treatment and care as a benefit the insurer decides case by case rather than a blank cheque. The test is whether it's reasonable and necessary, and the benefit period that applies to you sets the outer limit. Keep a running list of what's been requested, approved and declined. That list is useful if you ever need to challenge a decision.
Rules change
The scheme has changed more than once since 2017. What applies to you depends on your accident date, so check the current rules before relying on any detail.

Working with the insurer and your case manager
Once your claim is lodged, the insurer usually assigns a case manager. They're your main contact for payments, benefit requests and paperwork. Keep a simple log of each call: the date, who you spoke with and what was agreed. If something is promised by phone, ask for it by email so you have a record.
- Ask for important decisions in writing
- Note the date on any decision letter
- Ask what a request is for if it's unclear
The first decisions on your claim
Lodging starts the insurer's clock as well as yours. The insurer generally confirms it has your claim, gives you a claim number and puts a case manager in charge of it. Expect requests for more detail about your earnings and the crash, and a form asking for your consent to collect records. Reply quickly and keep copies, because slow replies can hold up a decision on your weekly payments.

Threshold injuries and your benefit period
The 52-week limit isn't only about threshold injuries. For accidents from 1 April 2023, it generally applies too if you were wholly or mostly at fault, whatever your injury. For accidents between 1 December 2017 and 31 March 2023, both limits were 26 weeks instead. Children who were 16 or under at the time of the accident are an exception: they can receive treatment and care for as long as they need it, regardless of fault.

Do you need a lawyer to make a CTP claim?
Lodging a CTP claim is something most people do without any legal help. A few situations change that. Here's a quick guide to which is which.
Often worth talking to a lawyer
- Your injury has been classed as threshold and the evidence says otherwise
- Someone died in the crash
- Another driver was at fault and your injury is more than threshold
- The insurer says you were mostly at fault
You may not need one
- The insurer is approving your benefit requests
- The insurer has accepted your claim
- You're lodging within 28 days with the paperwork ready
Lodging late costs more than lodging imperfectly. Get the claim in within 28 days if you can, even if a document is missing, and send the rest when the insurer asks for it. CTP claim time limits

Frequently asked questions
Yes. A claim made within 3 months of the accident is still possible, but weekly payments may then run only from the date you claimed. For accidents from 1 April 2023, if you give a full and satisfactory explanation for the delay, you may still be paid from the day after the accident. An explanation the insurer doesn't reject within 14 days is treated as accepted.
The insurer generally acknowledges the claim, gives you a claim number and assigns a case manager. It may ask for more information, such as payslips or your consent to obtain records, and it then decides whether to accept the claim and start weekly payments. Keep sending updated certificates and answer requests promptly. Decisions should come with reasons, and most can be reviewed if you disagree.
Most people use the Service NSW online form, and you can also lodge directly with the relevant CTP insurer. The form asks about the accident, the police event number, your injuries, and your work and income. Attach a Certificate of Fitness if you have one. Aim to have the claim in within 28 days of the accident, so weekly payments can generally be back-paid to the day after it.
No. Most people can lodge a CTP claim themselves, online through Service NSW or with the insurer, and CTP Assist can help with questions for free. A lawyer becomes more useful if the claim is refused, if you're outside the time limits, if the insurer disputes your injury or fault, or if you may have a damages claim. Our free claim check can tell you which applies.
Only in limited circumstances, usually where there's a full and satisfactory explanation for the delay. The rules are strict and depend on your facts. Speak to a lawyer straight away if you're outside 3 months, and gather anything that shows why you couldn't claim sooner, such as a period when you couldn't manage your affairs, or an injury whose seriousness only became clear later.
A CTP claim pays statutory benefits as you go, and most injured people can claim them regardless of who was at fault. They include weekly payments if you can't work, or can't work as much, and treatment and care that is reasonable and necessary for your injuries. How long they last depends on your injury, your share of fault and your accident date. CTP covers people, not vehicles, so car repairs are a separate matter.
