Your first months: the CTP claim timeline
These are the dates that shape most statutory benefits claims in NSW. Missing an early one can cost weeks of payments, so it helps to know them before you need them.
Day 0
The accident
Safety comes first, then the paperwork. Report the accident to police, keep the event number, and write down the date, time and place while they're fresh, since the claim form asks for all three.
Within 28 days
Lodge your claim
Lodge your claim for statutory benefits within 28 days of the accident so weekly payments can generally be back-paid to the day after. You can lodge through Service NSW online or with the CTP insurer.
Within 14 days of your explanation
A late claim, explained
For accidents from 1 April 2023, a claim made after 28 days but within 3 months may still be back-paid if you give a full and satisfactory explanation. If the insurer doesn't reject it within 14 days, it's treated as accepted.
Within 3 months
The last point to claim
Three months after the accident is the practical cut-off. Later claims can only be accepted in limited circumstances, usually with a full and satisfactory explanation. If you're past it, speak to a lawyer straight away.
Weeks 1–13, then 14+
Weekly payment rates
For the first 13 weeks, payments are up to 95% of what you earned before the accident. After week 13 the rate becomes up to 80% or 85%; your earning capacity decides which. A legislated maximum applies.
52 weeks
The threshold and at-fault line
At 52 weeks, people with a threshold injury, and people wholly or mostly at fault, generally stop receiving weekly payments and treatment and care. For accidents between 1 December 2017 and 31 March 2023, that limit was 26 weeks.
104 weeks
Weekly payments generally end
Two years in, weekly payments generally stop unless you've lodged a damages claim that's still pending. To keep them going past 2 years, that damages claim must be lodged within 2 years of the accident.

Lodging your claim: the practical steps
There are two main ways to lodge: the Service NSW online form, or the CTP insurer itself. Either way, you'll be asked for the accident date and place, the vehicles involved, your injuries, your employer and income, and any witnesses. Most people can complete it themselves in one go if they have the details to hand.

The 52-week limit and who it applies to
The 52-week limit isn't only about threshold injuries. For accidents from 1 April 2023, it generally applies too if you were wholly or mostly at fault, whatever your injury. For accidents between 1 December 2017 and 31 March 2023, both limits were 26 weeks instead. Children who were 16 or under at the time of the accident are an exception: they can receive treatment and care for as long as they need it, regardless of fault.

Your claim paperwork checklist
The claim goes more smoothly with a few things ready: the police event number, the other vehicle's registration, your Certificate of Fitness, payslips or tax records showing what you earned, and your employer's details. If you've paid for anything out of pocket because of the crash, keep the receipts too. Missing something shouldn't stop you lodging on time.
- Date, time and place of the crash
- Registration numbers of the vehicles involved
- Recent payslips, tax returns or business records
- Receipts for costs you've paid because of the crash
- Names and numbers of any witnesses

Weekly payments and the other benefits
Weekly payments replace part of your income while the injury keeps you off work or on reduced hours. The insurer sets your rate from what you earned before the accident, so give it the full picture from the start: every job you held and the hours you usually worked. A legislated maximum applies and is indexed each year, so the cap itself changes over time.
Think of treatment and care as a benefit the insurer decides case by case rather than a blank cheque. The test is whether it's reasonable and necessary, and the benefit period that applies to you sets the outer limit. Keep a running list of what's been requested, approved and declined. That list is useful if you ever need to challenge a decision.
Rules change
Benefit rules depend on your accident date and have changed over time. This is general information; check the current rules or ask CTP Assist.

After the claim goes in
Most of the early weeks after lodging are paperwork. The insurer may ask for tax returns, the other driver's details or a signed authority to collect records, and it will send its decision on liability and weekly payments. Keep every letter in date order. If a promised payment or decision is late, ask your case manager in writing when it's due, and call CTP Assist on 1300 656 919 if you're stuck.

Your case manager and what to expect
Insurers make decisions under the scheme rules, and your case manager is the person who passes them on. Most contact is routine: updated certificates, benefit decisions, payment questions. Reply promptly, keep copies of what you send, and ask for written reasons for any decision you don't understand. You can challenge decisions if you need to.
- Ask for important decisions in writing
- Send updated certificates before the old one runs out
- Note the date on any decision letter
When to get more help
If you lodged late, the stakes are higher: claims more than 3 months after the accident are accepted only in limited circumstances. The same goes if you've received a settlement offer or a letter you don't understand. In those situations, an independent lawyer's view is usually worth getting sooner rather than later.

Lodging alone, or with help?
Plenty of claims run from start to finish without legal help. A few need it early. If you recognise your situation below, you'll have a fair idea where you stand.
Often worth talking to a lawyer
- The insurer says you were mostly at fault
- Your claim went in more than 3 months after the accident
- Your injury has been classed as threshold and the evidence says otherwise
- You've been asked to sign a release or settlement
You may not need one
- Your weekly payments arrive on time and the amount looks correct
- You just need to know which insurer to claim against
- The insurer has accepted your claim
Many stalled claims are missing something simple: an event number, payslips or a current certificate. Ask your case manager in writing what's outstanding, then send it and keep a copy. What happens after you lodge

Frequently asked questions
A CTP claim pays statutory benefits as you go, and most injured people can claim them regardless of who was at fault. They include weekly payments if you can't work, or can't work as much, and treatment and care that is reasonable and necessary for your injuries. How long they last depends on your injury, your share of fault and your accident date. CTP covers people, not vehicles, so car repairs are a separate matter.
No. It helps to send one with your claim, because the insurer uses the Certificate of Fitness to see your injuries and what work you can do, and that affects weekly payments. But lodging on time matters more. If you don't have one yet, lodge within 28 days anyway and send the certificate when you get it. Keep updated certificates coming while you're off work, as gaps can hold up payments.
Generally up to 104 weeks, or 2 years. For a threshold injury, or if you were wholly or mostly at fault, they generally stop at 52 weeks for accidents from 1 April 2023. Beyond 104 weeks, payments continue only in limited cases where a damages claim is still pending, which how compensation works explains. Keep your Certificates of Fitness current throughout, because gaps can interrupt payments.
Only in limited circumstances, usually where there's a full and satisfactory explanation for the delay. The rules are strict and depend on your facts. Speak to a lawyer straight away if you're outside 3 months, and gather anything that shows why you couldn't claim sooner, such as a period when you couldn't manage your affairs, or an injury whose seriousness only became clear later.
Start with the police event number, the registration of the vehicles involved, your Certificate of Fitness and proof of your earnings, such as payslips or tax returns. Receipts for out-of-pocket costs and witness details help too. You don't need everything to lodge. It's better to lodge on time and send extra documents when the insurer asks for them.
Generally yes, if your Certificate of Fitness says you have some capacity for work. Weekly payments may be adjusted to take account of what you earn after the accident, so tell the insurer about any work or income straight away. Keep your payslips and a note of your hours. If a change in your hours affects your payments, ask the insurer to explain the new amount in writing.
