Do I need a lawyer for my CTP claim?

Not always. Many people manage a statutory benefits claim themselves, especially while benefits are being paid and their injuries are improving. Legal help tends to matter most when a claim is denied, benefits are cut off, the insurer says your injury is a threshold injury, fault is disputed, you've been offered a settlement, or you may have a damages claim. We'll tell you honestly which applies to you.

Can you help me find a doctor or allied health provider?

Accepted Answer

Yes. If you need treatment, a Certificate of Fitness or medical evidence for your claim, we can point you to a doctor experienced with CTP claims, or to allied health such as physiotherapy, psychology or exercise physiology. The CTP insurer generally pays for treatment and care that is reasonable and necessary for your accident injuries, within the benefit periods that apply to you. The insurer decides what's approved, and its decisions can be reviewed.

Is CTP Lawyer a law firm?

No. CTP Lawyer is not a law firm or a healthcare provider. We don't give legal or medical advice and we don't act for you. We look at where your claim is up to and point you to the help it needs: an independent specialist CTP lawyer when your case calls for it, and doctors and allied health for treatment and the medical evidence a claim runs on.

Does it cost anything?

The claim check is free and there's no obligation. If you decide to engage a lawyer, their fees are an arrangement between you and them. Many motor accident lawyers offer no win, no fee arrangements — ask exactly what that covers and get a written costs disclosure before you sign anything. For treatment, ask the provider how their fees are handled with the CTP insurer before you start.

Do I need a claim number?

No. Many people get in touch before they've lodged a claim. If you haven't lodged yet, timing matters: to have weekly payments back-paid to the day after the accident, the insurer generally needs your claim within 28 days, and you can generally still claim up to 3 months after the accident.

Question 7

I was partly or fully at fault. Is it still worth doing?

Accepted Answer

Yes. Most injured people can claim statutory benefits regardless of who was at fault. If you were wholly or mostly at fault, weekly payments and treatment and care are generally limited to the first 52 weeks (for accidents from 1 April 2023) and common law damages aren't available. Fault is also sometimes less clear-cut than it first seems.

The insurer has made an offer. Should I accept it?

Accepted Answer

No one can answer that without looking at your situation. A settlement is generally final, so it's worth having an independent CTP lawyer check any offer before you sign.

What happens to my details?

Accepted Answer

We use them to contact you about your claim. We only pass them, including any health information, to an independent lawyer or healthcare provider if you agree, and only for this enquiry. That's what the consent box on the form is for. We'll tell you if a provider we refer you to is connected with us. Our privacy policy explains the rest.
